NOTICE OF SEIZURE AND INTENDED FORFEITURE

And all others claiming an interest in the above-described property.

You are hereby notified that the State of Oklahoma has seized and intends to forfeit the following described property:

REAL PROPERTY AND PREMISES SITUATED IN THE SOUTHWEST QUARTER (SW) OF SECTION 24, TOWNSHIP FOUR (4) SOUTH, RANGE THIRTEEN (13) WEST, OF THE INDIAN MERIDIAN, COTTON COUNTY, STATE OF OKLAHOMA, TO WIT:

MONTGOMERY MEADOWS, BLOCK 1, LOTS 10-14 AND BLOCK 1, LOTS 18-22 WHICH SAID PROPERTY HAS A STREET ADDRESS OF 250247 E 1950 RD, DEVOL, OK 73531-4347.

It is alleged that the aforementioned real property is real property which is used, or intended to be used in any manner or part to commit or to facilitate the commission of a violation of the Uniform Controlled Dangerous Substance Act which is punishable by imprisonment for more than one (1) year, to wit: the unlawful manufacture, cultivation or distribution of controlled dangerous substances, marijuana. Said real property is forfeitable pursuant to 63 O.S. §2-503(A)(8).

With respect to all seized property, personal and real, any property or thing of value is subject to forfeiture if it is established by a preponderance of the evidence that such property or thing of value was acquired by such person during the period of the violation of the UCDSA or within a reasonable time after such period and there was no likely source for such property or thing of value other than the violation of the UCDSA. Said property is forfeitable pursuant to 63 O.S. §2-503(B).

On information and belief, the evidence will show that the above property was being utilized in an ongoing and continuous manner to unlawfully grow/manufacture and distribute marijuana for commercial gain contrary to 63 O.S. § 2-401 et seq. Further, it is alleged that the evidence will show that there exists a robust illicit marijuana market in Oklahoma which has generated significant profit in the form of acquisitions of criminal proceeds and property. Furthermore, the prevalence of this illicit marijuana market has presented an ongoing and continuous threat to public health and safety in Oklahoma.

The evidence will show that ZHIJUN HOU acquired and utilized said real property to operate a marijuana grow operation under fraudulent licensure and registration and has continued to operate said marijuana grow operation in violation of the Uniform Controlled Dangerous Substances Act. Beginning on or about August 17, 2021, ZHIJUN HOU did knowingly or intentionally furnish, or cause to be furnished, false or fraudulent material information in, or omit material information from, an application, report, or other document required to be kept or filed under the Uniform Controlled Dangerous Substances Act, or a record required to be kept by the Uniform Controlled Dangerous Substances Act; by stating to wit: that THEODORA BEKEDEREMO was the majority Oklahoma resident owner of ZJHOU FARM LLC, OBN Application No. 02626, located at 250247 E 1950 Rd, Devol, OK 73531, with knowledge that BEKEDEREMO was not a direct beneficial owner of the enterprise with no concomitant role in directing or managing the affairs of the enterprise in violation of 63 O.S. § 2-406(A)(4) of the Uniform Controlled Dangerous Substances Act.

From on or about November 30, 2021, to December 8, 2022, ZHIJUN HOU did knowingly or intentionally furnish, or cause to be furnished, false or fraudulent material information in, or omit material information from, an application, report, or other document required to be kept or filed under the Uniform Controlled Dangerous Substances Act, or a record required to be kept by the Uniform Controlled Dangerous Substances Act; by stating to wit: that LAWANA HERNANDEZ was the majority Oklahoma resident owner of ZJHOU FARM LLC, OBN Registration No. 10003444, located at 250247 E 1950 Rd, Devol, OK 73531, with knowledge that HERNANDEZ was not a direct beneficial owner of the enterprise with no concomitant role in directing or managing the affairs of the enterprise in violation of 63 O.S. § 2-406(A)(4).

From on or about March 4, 2022, to October 31, 2022, ZHIJUN HOU did knowingly or intentionally furnish false or fraudulent information…

Since on or about November 30, 2021, ZHIJUN HOU has knowingly or intentionally manufactured one thousand (1000) or more marijuana plants…

Since November 30, 2021, ZHIJUN HOU has knowingly distributed or possessed with intent to distribute one thousand (1,000) pounds or more of marijuana…

According to the Cotton County Assessor’s records and the Cotton County Clerk’s records, said real property which is at issue is owned by ZHIJUN HOU.

Further notice is hereby given that within forty-five (45) days after receiving this Notice, the owner, claimant, or other party in interest may file a verified answer and claim…
